Terms of Service

By accessing the Capstone Enterprises website, requesting a quote, or hiring us for landscape construction and property maintenance, you agree to be bound by these Terms of Service. These terms apply to all residential and commercial clients. If you do not agree with any part of these terms, you must not use our services. We reserve the right to update these terms at any time without prior notice.

Our services—ranging from custom decks, fences, and pavers to irrigation and retaining walls—are performed based on the specific scope outlined in your service agreement. While we strive for timely completion, project timelines cannot be strictly guaranteed due to weather conditions, material availability, and unforeseen site complications.

All estimates are preliminary and subject to a full site inspection. Final pricing is determined by the project's scale, material choices, and terrain difficulty. For construction projects, a deposit may be required before work begins. For ongoing commercial and residential groundskeeping, payments are due as specified in your agreement. Past due accounts may be subject to a late fee.

The Client is responsible for ensuring the service area is accessible and free of obstacles. For construction and drainage projects, the Client must disclose the location of any private underground utilities (e.g., dog fences, private electrical lines) not covered by standard municipal locating services. Capstone Enterprises is not responsible for damage to unmarked private utility lines.

Landscape construction involves heavy machinery and significant site alteration. While we exercise reasonable care, Capstone Enterprises is not liable for minor disruptions to existing lawn areas outside the immediate work zone, natural settling of soil, or unforeseen subterranean conditions (such as excessive rock or groundwater) that may alter the scope of work.

We take pride in transforming your outdoor spaces into a luxurious oasis of tranquility. However, living materials such as plants, trees, and sod require proper watering and ongoing care after installation. Warranties on living materials and hardscapes are outlined in your specific contract. Neglect, improper maintenance by the Client, or extreme weather events will void these warranties.

Clients may cancel ongoing property maintenance with written notice as specified in their contract. For custom construction projects, cancellations made after materials have been ordered or work has commenced will result in the forfeiture of deposits and billing for any labor and materials utilized up to the termination date.

These Terms of Service and any disputes arising out of or related to the services provided by Capstone Enterprises shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
